Restrictive Covenant
K Ltd. received late notification of a property going to auction in which they were interested. The property was subject to an old restrictive covenant in favour of the monarch of the time. K Ltd. sought advice regarding this covenant from two separate firms of solicitors that they used. Both gave conflicting advice ,both recommending that counsel’s opinion should be sought and both saying that it would be very difficult to do this in the time available. yourbarrister obtained the necessary opinion well in time for the auction and at half the cost quoted by one of the solicitors. This allowed the company to make the purchase and subsequently secure a half million pound profit.
